From: To: ; ; ; ; Subject: (Veterans, A Minority Report) Date: Tuesday, November 12, 2002 6:05 PM Wes Brickner 800 Oro Terrace San Pedro, CA. 90731-2936 (310) 519-0314 Wesoat@aol.com November 12, 2002 Dear Kevin, Bean, Ralph and Lisa May: Well it was about time that you finally had veterans as a category on "Know Your Minorities", being a veteran of the Vietnam war as a spy for the Army Security Agency I cannot remember which one of you is obsessed with spies and Delta Force but I will tell you a secret that very few people on the planet were aware of during the Vietnam war and was never reported to the press or the country. I was intrigued by the segment on Armenians today and thought that now was the time to bring to your attention of the genocide being perpetrated on our veterans in this country. This fact and feat is being accomplished by federal contractors worldwide, our government and our court system. All federal contractors with 50 or more employees and contacts over $50,000.00 must have, as a term and condition of their contracts with the federal government, an Affirmative Action Program for veterans. These laws are being totally ignored by the majority of federal contractors worldwide. The Department of Labor-Office of Federal Contract and Compliance Program (OFCCP) is responsible for the administration and compliance of these laws by federal contractors. The OFCCP has a 1.5 Billion dollar annual budget for 3000 employees. Veterans have had to sue our own government (the OFCCP) in order to obtain and secure our rights from federal contractors. This is despicable given all of the patriotism being displayed since 911. (The United States of Facadica) Even after suing the OFCCP, in federal court, where the judge found that the OFCCP's investigation was a "SHAM" and ordered them to enforce the law on my employer, they still have not complied with the court order which is now 7 years and 11 months old. The national office of the OFCCP sent an "enforcement recommendation", against my employer, to the national office of the U.S. Solicitors office in 1996, over 6 years ago and they still have done nothing. Here is where it becomes very interesting. This summer President Bush made a "recess appointment" to the U.S. Solicitors national office to Mr. Eugene Scalia, son of U.S. Supreme Court Justice Anton Scalia. Mr. Eugene Scalia works for Gibson, Dunn and Crutcher's (or like we prefer to refer to them as Gippum, Dumb and Crooked) Washington office. This law firm, which originated back in the 1860s, is one of the largest law firms on the planet having offices in major cities all over the globe. This law firm represents my employer who the OFCCP sent the enforcement recommendation to the Solicitors national office against. This is an obvious conflict of interest and is very suspect when the government agency responsible for enforcing the law on my employer is headed by a member of the law firm who represents my employer. I believe this is a conspiracy, collusion and obstruction of justice by my employer, the law firm which represents them and the federal government. Oh, by the way, my employer is the Pacific Maritime Association (PMA) who may sound familiar if you have been reading about the West Coast "Lockout" of the International Longshore and Warehouse Union (ILWU) in all the ports up and down the coast from Alaska to San Diego. The PMA and its member companies, who are major federal contractors, receive hundreds of millions of dollars in federal contracts each year, hundreds of millions of dollars in federal subsidies each year, are tax exempt, receive millions of dollars each year to maintain their vessels and all the laws of commerce are slanted and bias in favor of their businesses. Pretty sweet deal the PMA has with the government. However, the PMA has been in non compliance with these Affirmative Action Programs since their inception over 30 years ago. I know this because I have been fighting the PMA for 30 years seeking my veteran rights from them. Mr. Dennis Gladwell, of Gibson, Dunn and Crutcher, in a letter to the OFCCP national office stated that the PMA "...is a small, nonprofit corporation, and not an employer of longshoremen...". The Sierra Club lost its nonprofit organization status because they have lobbyists. PMA has numerous lobbyists and yet they are allowed to retain their nonprofit organization status regardless of that fact. He also stated, along with PMA officials, Carrie Clements and Charles Young, to OFCCP investigators that the PMA had only 30 employees. PMA's 1988 annual report states that they handed out 32,000 W-2's. These ridiculous statements are false and lying to federal investigators carries a $50,000.00 fine and 5 years in prison. Mr. Gladwell has retired early from Gibson, Dunn and Crutcher and moved to Utah. Carrie Clements retired early from PMA and moved back east to the Boston area. Charles Young also retired early from PMA and moved to New Zealand where there is no extradition agreement with the U.S. Judge David Kenyon found all of these statements, by PMA representatives, PMA attorneys and findings by the OFCCP investigators to be a "SHAM". I have met other veterans, in other industries (20th Century Fox, Los Angeles County Fire Department and California State University Long Beach) who have all suffered the same identical treatment by their employers and the OFCCP. We formed the Veterans Rights Advocates and have been to many offices of members of the congress and senate seeking help and reform only to be ignored. A high ranking official who works with the Veterans of Foreign Wars (VFW), Veterans Administration (VA) and the Disabled American Veterans (DAV) stated to one of our Veterans Rights Advocates (VRA) members that he heard it was only 35%, implying that it had gone down. What he failed to understand, when asked why he felt the percentage was lower, was that it was not because the OFCCP had obtained jobs for those veterans in the 5% decline but rather that those veterans in the 5% difference had died!
