I just spoke with Wanda and she suggested that I email you with the following questions and queries.
I do not know if it is imperative that I come out there at this time. Basically, I just need answers to a few questions. You may not be able to answer them with a yes or no and they may take some legal research or consultation with your network of legal buffs. However, you may want to email me or have a phone conference at this time instead of me coming out there prematurely.
My main question is should we wait to file in federal court? The parties in my arbitration are not cooperating and they seem to be delaying the outcome as long as possible. It has been two years since our arbitration hearing. I know there is a case law that states you do not have to exhaust your administrative remedies if those remedies are the ones which are discriminating against you and denying you your rights. So should we file our claim in federal court immediately?

The other questions can be addressed at another time or when I do come out there to meet with you. They concern the possibility of your firm taking on a Class Action lawsuit against the DOL-VETS, DOL-OFCCP and numerous federal contractors on the behalf of thirty million veterans who have been denied their employment, reemployment and Affirmative Action rights by these entities. It might be beneficial if your firm could research the possibility of using the “Fairchild v. Robert Reich Sec. of Labor, CV 92-5765 Kn” case as an outline and as a “notice of related cases” for this Class Action lawsuit.
